Terms of Service

1. The Service

Fvmily is a household management service that helps families share calendars, lists, messages, routines, and related tools across the devices they already own. The Service is under active development. Features, availability, and pricing may change over time.

2. Eligibility and Accounts

You must be at least 18 years old to create an account and accept these Terms. A parent or legal guardian may add their children to a household account and is responsible for supervising the children's use of the Service. You agree to provide accurate information, keep your credentials confidential, and notify us promptly of any unauthorized use of your account. You are responsible for activity that occurs under your account.

3. Subscriptions and Billing

Some features of the Service are or will be available only with a paid subscription. Pricing and billing cadence will be presented to you before you subscribe. By subscribing, you authorize us (or our payment processor) to charge the payment method you provide on a recurring basis until you cancel. Subscriptions renew automatically unless cancelled before the renewal date. Except where required by law, fees are non-refundable.

4. Acceptable Use

You agree not to:

• Use the Service in violation of any law or third-party right.
• Harass, abuse, threaten, or harm any person, or post content that does so or that is unlawful, hateful, sexually explicit, or otherwise objectionable.
• Attempt to access another user's account, household, or content without authorization.
• Reverse engineer, decompile, scrape, or otherwise interfere with the Service or its underlying technology.
• Use the Service to send spam, distribute malware, or disrupt the Service or networks it connects to.

We may suspend or terminate access to anyone who violates these Terms.

5. Your Content

You retain ownership of the content you create or upload within Fvmily ("Your Content"). You grant Fvmily a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, and process Your Content as needed to operate, provide, and improve the Service for you and the members of your household. You represent that you have all rights necessary to share Your Content with us and the people you invite to your household.

6. Intellectual Property

The Fvmily name, logo, software, and content (other than Your Content) are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. No other rights are granted.

7. Third-Party Services and Devices

The Service may connect with third-party services, devices, or platforms (for example, calendar providers or smart home devices). Your use of those services is subject to their own terms, and Fvmily is not responsible for them.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FVMILY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to indemnify and hold Fvmily and its affiliates harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, or your violation of these Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms or if we discontinue the Service. Sections intended to survive termination (including Sections 5, 6, 8, 9, 10, 12, and 13) will continue to apply.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, U.S.A., without regard to conflict of law principles. The exclusive jurisdiction and venue for any dispute relating to these Terms or the Service is the state and federal courts located in Spokane County, Washington, and you consent to personal jurisdiction there.

13. Changes to the Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and, when appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
